Car Tire Burst: Most of the people remain unaware of the Car Insurance Claim received due to a car accident or a sudden fault in the vehicle. As per the rule, if you are driving a car and it suddenly breaks down on the way or because of which someone dies in an accident, then the insurance companies are bound to pay the claim.

In fact, the Bombay High Court has given an important decision in a case of tire burst of a moving vehicle. This case is related to the death of a car rider due to tire burst. The insurance company had argued in the court that the death due to tire burst was a divine event, while the court rejected this argument and termed it as human negligence. The court has also directed the insurance company to pay compensation of Rs 1.25 crore to the family of the deceased.

What is the matter?
Makarand Patwardhan was going from Pune to Mumbai on 25 October 2010 with two of his colleagues. Meanwhile, due to the bursting of the rear tire of the car, his car went uncontrolled and fell into a deep ditch. In this accident, 38-year-old Makarand died on the spot. On 17 February, a single bench of the Bombay High Court dismissed the appeal of ‘New India Assurance Company Limited’ against the 2016 judgment of the Motor Accident Claims Tribunal in this case.

The company said divine event
The New India Assurance Company Limited, in its petition, had called the accident a divine event and not the negligence of the driver. However, the court ignored this argument of the insurance company. The court said that man is not responsible for an unexpected natural event. But tire burst cannot be called a divine event. This is completely a matter of human negligence.

Victim’s family got relief
Ruling in favor of the family of the deceased, the court has ordered the insurance company ‘New India Assurance Company Limited’ to pay Rs 1.25 crore as compensation. The court also emphasized in its order that the driver or owner of the vehicle should check the condition of the tires before the journey.
