‘The Voice Within…Social Messages through Judgments’, Authored by Justice Kailash Gambhir

Hon’ble Mr. Justice T S Thakur, Chief Justice of India, who was the Chief Guest of the function, released the book in presence of eminent dignitaries like Hon’ble Mr. Justice Madan B Lokur, Judge, Supreme Court of India; Hon’ble Mr. Justice A K Sikri, Judge, Supreme Court of India; Hon’ble Mr. Justice Vijender Jain, Chairperson, Human Rights Commission, Haryana and Uttarakhand; Mr. Kailash Satyarthi, Nobel Peace Laureate; many serving and retired Hon’ble Judges from the Supreme Court of India and Delhi High Court; and senior advocates, bureaucrats and police officers, academicians and corporate counsels.
During the occasion, Hon’ble Mr. Justice T S Thakur said, “Justice Gambhir is a very articulate and clear-headed man with a multi-dimensional personality. He is someone who has walked with the kings but never lost touch with the common man and the mundane realities of life. He is sensitive towards those associated with him and those who have appeared before him as litigants. His sensitivity is reflected in some paragraphs of his various judgments listed in the book. The way he has penned down these judgments reflects his deep sensitivity towards public and social issues about the internal situation of the country and plight of the citizens. The work done by Justice Gambhir would inspire teachers and lawyers not only in theory quest for justice but also in their crusade against injustice wherever the same exists.” Justice Thakur also suggested that a memoir should be written on the tedious journey of a judge’s life, how a judge’s mind works, what challenges he faces and the conflicts he fights within his own mind. He advised Justice Gambhir to write his memoir on what he saw, felt and experienced as a lawyer and as a judge.

Congratulating the author on his achievement, Hon’ble Mr. Justice Madan B Lokur said, “The author has a great heart, is a down-to-earth man and knows a lot about society. The book is worth reading as it’s an effort that has come out directly from the heart of Justice Gambhir. The book has drawn a huge canvas, where different issues relating to crime, dacoity, shortage of public prosecutors, mode of service of summons, motor accidents cases, etc., have been covered. Cases of Original and Writ side have been dealt with and discussed in the book. What is reflected in these judgments is the compassion that the author has for the weaker sections of the society, the disadvantaged people. The problems of the society have been looked upon differently by him. The views he has expressed throughhisjudgements are different and serve public purpose at large. I am sure that the book will be an excellent guild for the legal fraternity and those of us seeking justice with compassion.” He also suggested that it will better if Justice Gambhir’s recommendations that were put forth in all these judgments are compiled together, as it will bring tremendous benefit to the justice delivery system. He also added, “Justice Gambhir’s recommendations are more than his expression of views; these are pragmatic, practical and if implemented will do great public service.”
Other distinguished guest at the function, Hon’ble Mr. Justice A K Sikri spoke about two catchphrases – ‘The Voice Within’ and ‘Advancing the Rule of Law’. He said, “There are two kinds of judges – one who straight away applies the law without stepping outside the four corners of the statues and the other, the pragmatic one, who fulfills the rule of law and also advances it. The pragmatic ones don’t follow a usual set pattern; they apply discretion while interpreting and that’s how the voice from within comes into the picture. This voice from within is important for advancing the rule of law. This book depicts the picture of the deep understanding of the casual routine matters that have a heavy bearing on the day-to-day life of a common man. Some judgments are simpliciter and others leave behind some philosophy, advancing the rule of law. Judges usually give judgments, but what is commendable is the effort taken in culling out these selected judgments by the law clerks of Justice Gambhir. The book is worth reading and I am confident that the book is going to be very useful for students, lawyers and judges.”
Hon’ble Mr. Justice Vijender Jain, another guest of honour, said, “The zeal with which Justice Gambhir works is known. He did bother about the law but also went into questioning the substantive delivery of justice. The hallmark of justice rendering system is compassion that a judge is filled with; it’s always that greater the judge, lesser the discretion he exercises.”
Nobel Peace Laureate, Mr. Kailash Satyarthi said, “Judges are the true representations of how the spirit of the Indian Constitution can work for the betterment of the country. My Nobel Peace Prize would not have been possible without the endeavors of the Indian Judiciary. We have to look as to how the Indian Judiciary can help us achieve the four F’s – Freedom, Fearlessness, Faith and (children) Friendly judgments. The essence of any constitution lies in the protection of its weakest section: Children. The State of justice will only be upheld when it reaches the last, most vulnerable personof the society. Justice Gambhir’s book launch has brought together a venerable gathering of members of the judicial bench and I demand that we adopt Child-Friendly court procedures with a special focus on our Victims and Witness Protection Scheme and expedite trials related to child sexual exploitation.”
Justice Kailash Gambhir thanked all the dignitaries for their compliments and for attending the function. He mentioned that the book was an attempt to compile some of his select judgments containing social messages with an endeavor to sensitize the masses on a plethora of social issues that we, as a society, are confronted with. He appreciated the efforts of all thelaw researchers, without whom this task of sorting and compilation of the voluminous database of
judgments would not have been possible.
